TERMS AND CONDITIONS
1. DEFINITION AND SUBJECT MATTER OF THE CONTRACT
This agreement (‘Contract’) is a distance contract within the meaning of Art. 50 et seq. of Legislative Decree. 6 September 2005, no. 206 (‘Consumer Code’). The object of the Contract is the sale of movable property between 19settetre per Maison Gabriella Chieffo, with registered office in Lecce (Le) at Piazzetta dei Longobardi no. 5, VAT NUMBER 04690200755 (“19settetre”) and the consumer (the “Customer”). The Contract is concluded directly through the acceptance by 19settetre of a purchase proposal issued by the Customer via the Internet on the website www.gabriellachieffo.com (the “Site”) on the basis of the procedures described in article 3 below.
The sales prices of the products illustrated on www.gabriellachieffo.com are inclusive of VAT.
Delivery costs are free for Italy.
3. TERMS OF PURCHASE AND PAYMENT
19settetre offers payment by credit card (Diners, Visa, Mastercard, American Express ), Paypal, Google Pay, Apple Pay, Scalapay and by bank transfer in advance.
If you buy with Scalapay you receive your order immediately and pay in the number of instalments you have chosen. You acknowledge that the instalments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and you authorise such assignment.
The Customer warrants to 19settetre that he/she has the necessary authorisations to use the payment method chosen by him/her when confirming the order. Purchases are debited from the customer’s account when the order is processed. The company 19settetre reserves the right to suspend the processing of an order and any delivery in the event of refusal of authorisation of payment by credit card by officially accredited bodies or in the event of non-payment. The company 19settetre reserves the right to refuse to execute a delivery or to honour an order placed by a Customer who has not paid in full or only in part for a previous order or with whom there is a dispute in terms of payment.
The bank transfer is a secure and widely used method for those who do not have a credit card.
At the end of the purchase procedure, the payment details will be sent directly to the e-mail address indicated during data entry.
It is important to write in the reason for the transfer the order number, which will be communicated to you in the confirmation e-mail.

4. PRODUCT SELECTION
You can choose the desired product by navigating through the ‘Fragrances’ and ‘Room Fragrance’ sections in the site menu and thus directly accessing the product or product list. Once you have found the product you wish to purchase, simply indicate the quantity in the appropriate text field, then click on the image of the shopping cart located in the top right-hand corner to add the product to your shopping cart. On the ‘shopping cart’ page you will find a list of the products you have chosen, with the possibility of changing the quantities or deleting products you no longer wish to purchase. By clicking on the ‘Check out’ button, you will be directed to the data entry page required to complete your purchase. Once the purchase has been completed, an e-mail will be automatically sent to the address indicated during data entry with a summary of what was purchased and the bank details required in the case of payment by bank transfer in advance.
5.1 – DELIVERY COSTS
Italy: free shipping with a minimum order of EUR 55.00.
Europe: shipping costs calculated directly when purchasing online
Rest of the World: send an e-mail and you will receive an estimate of costs and time.
5.2 – DELIVERY SERVICES
Products are delivered to the address indicated by the Customer on his order. The Customer has a duty to verify the completeness and conformity of the information it provides to 19settetre. The latter cannot be held liable for the consequences in terms of delay or delivery error. In this context, all costs incurred in returning the order shall be borne entirely by the Customer. 19settetre cannot be held liable for delivery delays due to errors or disruptions attributable to carriers, in particular in the event of total or partial strikes of postal services and means of transport and/or communications.
5.3 – PROCESSING TIMES
Orders placed online at www.gabriellachieffo.com are monitored daily from Monday to Friday, except on public holidays. 19settetre endeavours to work and ship even on the same day as the order placed before 11 a.m., however the processing and preparation time of an order can be longer depending on the items and take between 1 and 2 working days. 19settetre informs its customers that shipments are not made on Saturdays, Sundays and public holidays. In the event that an order involves one or more products that are unavailable as well as one or more available products, 19settetre shall dispatch the order upon receipt of all the products constituting the order. If the customer wishes to receive the available products as soon as possible, he is advised to isolate these items in a specific order. The system will automatically send an e-mail to the Customer when the Products are shipped, provided that the e-mail address indicated in the order form is correct.

5.5 – PACKAGING
The products are packaged to comply with the applicable transport regulations, and to ensure optimal protection of the products during delivery. The customer is asked to comply with these same rules when returning products either for customer service, or when returning for convenience. When returning a product, if we find that the return is damaged due to insufficient quality packaging, 19settetre may decide to refund only part of the product or refuse to refund it if it cannot be resold.
5.6 – CUSTOMER’S RESPONSIBILITY FOR INSPECTION OF PARCELS UPON RECEIPT
19settetre recalls that it is the Customer’s responsibility to inspect his or her parcels upon receipt in the presence of the carrier and to immediately notify 19settetre customer service by email and the carrier of any anomaly observed (shock, damaged parcel, delivery date not in accordance with the normal terms of the delivery service). In the event that such remarks are not recorded on the delivery note presented to the Customer by the carrier, no claim concerning the condition of the package(s) shall be accepted by 19settetre.
5.7 – CARRIER DELIVERY DELAYS
In the event of a delivery delay with respect to the deadlines announced by the carriers, the Customer may contact 19settetre’s Customer Service by telephone or e-mail to lodge a complaint and open an enquiry to search for the parcel. It can happen that parcels are lost by carriers. The deadlines imposed by the carriers imply that the Customer declares the loss within 10 days after receipt of 19settetre’s shipping notice. Under these conditions, 19settetre undertakes to make the necessary complaints to the carrier. Once a complaint has been made and an investigation has been initiated, it can take three to four weeks to receive a return from the transporter. If the parcel is found, it will be sent immediately to the Customer’s address. In the event that the package is not found, the Customer may then request shipment of the same product (within the terms of availability) at 19settetre’s expense, or a refund of the sum paid. If the product(s) ordered is (are) no longer available at that time, 19settetre will refund the total amount of the products lost by the carrier.
5.8 – DAMAGED PARCELS
The Customer has the duty to check the condition of the package in the presence of the carrier and to notify on the delivery note any imperfection and/or anomaly even of partial deterioration. In the absence of the aforementioned notes, the product is deemed accepted by the Customer and cannot be the subject of any dispute concerning its delivery. The Customer shall inform 19settetre by e-mail as soon as possible so that 19settetre can be provided for as soon as possible. 6. GUARANTEES AND ASSISTANCE
For products purchased by the Customer, the rules on warranties and assistance relating to the sale of consumer goods are applicable to 19settetre.
7. OBLIGATIONS OF THE CUSTOMER
The Customer declares and warrants: (i) to be a consumer as defined in Art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by him for the performance of the Contract are correct and true.
8. RIGHT OF WITHDRAWAL
The customer has the right to withdraw from the contract entered into, without penalty and without specifying a reason, within 10 days of receipt of the products. The Customer may exercise the right of withdrawal, within the aforesaid term, by means of a written communication to 19settetre’s head office pursuant to Art. 4, to be sent by registered letter with acknowledgement of receipt or by e-mail or fax. A customer wishing to make use of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 10 days of receipt of the products. Pursuant to Article 55(2) of the Consumer Code, the Customer shall have no right of withdrawal in the following cases:
– supplying custom-made or customised products, or which, by their very nature, cannot be returned or are liable to deteriorate or expire rapidly (e.g. cosmetics, flowers, foodstuffs).
The costs of returning products are borne by the Customer. 19settetre shall return the products within 10 days of their receipt by the Customer: (i) the full price paid by the Customer if the product is returned complete with all its parts and functions; or (ii) that part of the price equivalent to the product actually returned by the Customer who has consumed the product to an appreciable extent and/or to such an extent as to significantly diminish its value.

The Contract is governed by Italian law. Any dispute relating to the application, performance, interpretation and breach of the Contract shall be within the jurisdiction of the Court of Lecce.
11. MAJOR FORCE
In any case of force majeure or unforeseeable circumstances, 19settetre shall not be liable for delay or non-delivery and reserves the right to terminate the contract in whole or in part, suspend or postpone its execution.
